R&D Result Licensing: Completed R&D results (including know-how, patents, and other forms of intellectual property) are licensed to enterprises for use through technology transfer. Early-stage technology transfers: Objects that businesses would like to cooperate with but at present without completed results can only jointly research and develop with enterprises via industry-academia collaboration.

Technology transfer projects involve  considerations for technologies, products, industrial characteristics and therefore, resulting in varied  licensing conditions. The basic principle is user paid, and uses non-inclusive licensing. Loyalty: It mainly considers costs and marketability (for example, production value of future or relevant products). Derivative loyalty: After a product is launched, derivative loyalty will be paid with a certain percentage of the total sales amount. If the PLC is long or the market share is high, then a certain percentage of the total sales amount is suggested to be used as the basis for derivative loyalty.

If it is the result of a NSTC project, please provide the approved list of expenses; for projects of MOEA or others, please provide sealed contracts. No documents need to be attached for results not produced by any projects.

Oral defense of a thesis is regarded as publication. It will be given a one year grace period when applying for the ROC and US patent, but in other countries, publication means the invalidity of the novelty. It is suggested that if an oral defense of a thesis is conducted before the patent application, to please sign the Confidential Consent Form (please see the information below); the e-file or paper copy of the thesis shall be postponed for publication; please ask the library to remove the abstract from publication.

At present, the University’s Evaluation Commission only approves full grants for patent applications filed in the Republic of China (ROC) and the United States (US). For patent applications filed in other countries, the applicant shall bear the relevant patent application expenses alone, in accordance with the proportions stipulated by the Management Guidelines for R&D Results and Patent Applications.

If the application is sent to the Evaluation Committee, then after the application is approved, a patent application will be provided by offices which are at present incorporating with the University for labor procurement. If the Inventor would like to bear the cost on their own, they can independently look for the firm.

Besides the patent proposal submission documents required by the University, a duly signed and sealed joint ownership agreement must also be attached.

Basically, allocation of technology transfer loyalty is decided by the technology transfer agreement.

1. Leftover funding of projects.
2. General Expenses for the National Science and Technology Council (NSTC) project, (They must be the R&D results of the NSTC projects and when writing off, the funding source from the NSTC must be noted.)
3. Other funding sources must comply with the rules of the Accounting and Statistics Office.

When writing off the said expenses, please cite the docket numbers of NYCU.

If the loyalty is of an early-stage technology transfer NSTC project, then initially, the loyalty needs to be declared in the application made to NSTC and the expense shall be approved by them as a non-industry-academia collaboration NSTC project. If the R&D results of an industry-academia collaboration project is owned independently by a business, then an amount of no less than 15% of the research expenses plus the loyalty of an early-stage technology transfer will be allocated to the project convener  in accordance with the NYCU Guidelines on R&D Results and Technology Transfer.

According to the Ministry of Education's regulations, when a university engages in industry-academia collaboration, it must enter into a written contract with the collaborating institution, and the following matters must be specified:

"If the collaborating institution requires the university to guarantee that the licensed technology or other matters do not infringe upon the rights of others, the contract shall clearly define the scope of compensation the university shall bear in the event of infringement."

In addition, based on the University's administrative meeting minutes, liability arising from willful misconduct or gross negligence shall not be waived in advance, and the maximum amount of compensation shall be limited to the actual amount received.
